BarPath Terms of Use

Welcome to BarPath. By using the BarPath mobile application, Apple Watch application, or related services, you agree to these Terms of Use. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use BarPath.

By using BarPath, you confirm that:

• You are legally able to agree to these Terms.
• You are physically able to participate in exercise activity.
• You are not using the service against medical advice.

2. Not Medical Advice

BarPath provides motion tracking, workout analytics, and AI-generated feedback for informational purposes only.

• BarPath is not a medical provider.
• The service does not provide medical advice, diagnosis, or treatment.
• Consult a qualified medical professional before starting or changing an exercise program.

3. Assumption of Risk

Exercise and weightlifting involve inherent risks, including serious injury or death. By using BarPath, you voluntarily assume all risks associated with strength training, resistance training, physical exertion, equipment use, and reliance on app metrics or recommendations.

You are solely responsible for your safety while exercising.

4. Release of Liability

To the fullest extent permitted by law, BarPath and its affiliates are not liable for personal injury, equipment damage, health complications, data inaccuracies, device malfunctions, software errors, AI-generated recommendation errors, or indirect or consequential damages.

Your use of the service is at your own risk. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

5. Your Data and Service License

You retain ownership of your personal information and workout records associated with your account. BarPath owns the software, algorithms, analytics models, designs, and other intellectual property used to operate the service.

You grant BarPath a limited worldwide license to host, store, process, and analyze workout and motion data as needed to:

• Provide the service.
• Sync workouts across your devices.
• Generate analytics and AI-based workout feedback.
• Maintain security and prevent misuse.
• Improve detection accuracy, reliability, and app features.
• Create de-identified or aggregated statistics.

Apple Health data is accessed only with your permission and is handled as described in the Privacy Policy.

6. AI-Generated Insights

BarPath may provide automated workout feedback generated with AI.

• AI outputs may contain errors.
• Recommendations are informational only.
• Final decisions about exercise intensity, weight, and safety are your responsibility.

7. Intellectual Property

All software, algorithms, analytics models, designs, and technology in BarPath are owned by BarPath.

You may not:

• Reverse engineer the service.
• Copy or decompile the software.
• Replicate or extract models.
• Build competing products using BarPath data.

8. Account Suspension

BarPath may suspend or terminate access if these Terms are violated. Sections relating to data licenses, liability, and intellectual property survive termination.

9. Governing Law

These Terms are governed by applicable law.

10. Changes to Terms

BarPath may update these Terms. Continued use of the service means you accept the updated Terms.
